Columbus Property Division Attorneys

Dividing the belongings is an important part of virtually every divorce. Depending on several factors, including the level of civility of your current relationship, how long you were married and the value of the property you own, property division can be relatively smooth — or it can be highly contentious, expensive and stressful.

At Massucci Law Group LLC, our team of divorce attorneys works to make division of assets emotionally and financially easier for our clients. At the same time, we will not sacrifice the property rights you've earned during your marriage. This is part of our comprehensive and dependable divorce representation in Ohio.

Dividing Marital Property In Ohio

Ohio is an equitable division state. Every asset included in your and your spouse's marital property is subject to division. Marital property is nearly anything purchased or earned by you and/or your spouse during your marriage. This may include your home, cars, bank accounts and investments. Even if only one spouse earned an income during the marriage, the other spouse earns an equitable share through his or her contributions to the household. Debts may also be subject to division.

One common controversy in a divorce is whether certain valuables are marital property or separate property. In general, separate property is anything one spouse owns solely, brought into the marriage and never allowed to become commingled with marital property. Generally, each spouse is able to retain their separate property. With decades of experience practicing family law in Ohio, we will go over your valuables, identify which assets are marital property, and work toward a fair settlement.

Same-Sex Marriage And Asset Division

The landmark 2015 U.S. Supreme Court decision in Obergefell v. Hodges made same-sex marriage legal throughout the country. That case originated in Ohio, but several states had already recognized the right of LGBTQ people to marry prior to Obergefell. If you were legally married in another state prior to 2015 and are now getting divorced in Ohio, the law will treat your divorce the same as any other divorce when it comes to property division and other matters.
