Addiction and recovery requirements for child custody

Child custody is often complicated for those who are battling addiction or currently in recovery in Ohio. In order for the courts to grant a parent child custody, the parent needs to meet certain requirements. Here are some of the most common things that a judge will require them to do.

Undergo random drug testing

One of the most common things that recovering addicts will need to do in order to gain child custody is undergo random drug testing. This often happens at a moment’s notice, and the individual usually is the one who needs to pay for these tests.

Complete a treatment program

Part of the recovery process often includes completing a treatment program. Some judges will order the individual to complete a specific program, and others will allow the individual to choose a program of their own. While the individual is in the treatment program, the judge will often talk to their counselors and doctors to get a good understanding as to how well they are responding to treatment.

Pass inspection of the living space

Many judges will want proof that the individual is able to provide a safe environment for the child. This is why a judge may have a home inspection done by someone of their choosing. If the judge finds that the environment isn’t safe, they might give the individual a certain period of time to fix any issues as long as they aren’t serious.

Just because an individual is currently recovering from an addiction doesn’t mean that they can’t get custody of their child. They will often have to complete strict requirements in order for the judge to grant them custody. However, many parents are more than willing to do this so that they can be present in their child’s life on a consistent basis.
